Mr Stuart Adrian Corp, of Subiaco in Perth, and Mr Brian Millwood Smith, of East Perth, were today sentenced in the District Court of Western Australia on a total of 29 charges brought by the Australian Securities and Investments Commission (ASIC) - Messrs Corp and Smith were each sentenced to three years in prison, to be released on a recognisance after serving 16 months

David Muir is sentenced to two years in prison to serve 10 months and then enter into a recognisance in the amount of $10,000 to be of good behaviour for 14 months - Mr Muir pleaded guilty to seven charges of making improper use of his position as a company director on 13 June 2006, and was remanded in custody from that date - Mr Muir was charged in relation to a directors meeting of Hallmark in October 1998, almost nine years ago!

Mr David Muir pleaded guilty today in the District Court of Western Australia on seven charges of making improper use of his position as a company director - the charges arose out of an investigation by ASIC - Mr Muir was charged in relation to a directors meeting of Hallmark Gold NL (Hallmark) in October 1998 when a number of resolutions were made - ASIC alleged that the prime purpose of the resolutions was to remove cash from Hallmark for the benefit of third parties known to Mr Muir - entities controlled by associates of David Muir, and that benefited from the transactions, included Davis Samuel Pty Ltd, Kamanga Holdings Pty Ltd, Qancorp Pty Ltd and CTC Resources NL

William Forge and Peter Clark were yesterday found guilty by a jury in the WA District Court, and sentenced on charges of making improper use of their positions as company directors - Forge was sentenced to two and half years imprisonment, to be released after serving 12 months upon entering into a recognizance release order - Clark was sentenced to 18 months imprisonment, to be released after serving nine months upon entering into a recognizance release order - they were directors of Hallmark Gold NL

Stuart Adrian Corp, of Perth has been arrested in relation to 85 charges concerning his holdings in shares in Hallmark Gold NL (now Hallmark Consolidated Limited) and Welcome Stranger Mining Company NL (now called Commsecure Limited) - Mr Corp is alleged to have warehoused shares in the two companies by the use of offshore entities - he then voted on related party resolutions at general meetings which delivered him a benefit
