a Funding Agreement is signed today that will protect the compensation entitlements of future James Hardie asbestos claimants - the signatories are James Hardie Industries NV, LGTDD Pty Limited (an Australian subsidiary of JHINV) and the NSW Government – under the agreement James Hardie has agreed to make annual contributions to a compensation fund to meet future claims for compensation by Australian claimants injured as a result of inhaling asbestos dust from products manufactured or sold by the company - James Hardie has also agreed not to restructure its business in future in a manner that will make it unable to meet its funding obligation (it has been estimated that James Hardie is likely to pay more than $4.5 billion in compensation over the next 40 years)
